GENERAL TERMS AND CONDITIONS OF SALE – Échappée

 

Article 1 – The Seller

 

These General Terms and Conditions of Sale are agreed between, on one hand, the SRL Beautiful Sports (hereinafter referred to as “BS”), whose registered office is located at Drève des Weigélias 29, 1170 Watermael-Boitsfort, and registered under BCE number 0772.546.206, contactable at the email address: info@beautifulsports.be, and, on the other hand, any individual, male or female, wishing to register and participate in the events organized by BS (hereinafter referred to as the “Participant”).

 

Article 2 – Purpose

 

2.1. These General Terms and Conditions aim to define the contractual relationship between BS and the Participant, as well as the conditions applicable to any purchase made on the BS website, accessible at https://www.echappee.be/.

 

2.2. These General Terms and Conditions, together with the conditions or notices on the Site, constitute the entirety of the provisions governing the contractual relationship between BS and the Participant.

 

2.3. The purchase of a service via the BS Site implies the Participant’s unconditional and explicit acceptance of these General Terms and Conditions of Sale. The electronic order process cannot be completed without checking the box “I accept the general terms and conditions.”

 

2.4. These General Terms and Conditions are accessible at any time on the Site and will prevail, where applicable, over any other version and over the Participant’s own purchase or other conditions.

 

Article 3 – Services Offered

 

3.1. BS’s primary purpose is the organization of recreational sports events, initiatives, or concepts for amateur cyclists.

 

3.2. The services offered are those listed in the catalog published on the Échappée Site (Cycling routes to explore our regions). These services are offered subject to availability or defined availability limits. Each service is accompanied by a complete description provided by Échappée on its website (registrations, content, duration, date, etc.).

 

3.3. The service offers by Échappée are made without commitment and only bind BS upon their unconditional acceptance by the Participant and upon BS’s written confirmation of the Participant's order.

 

Article 4 – Ordering and Payment

 

4.1. The Participant who wishes to purchase a Service must:

  • Complete the order form with all required details;
  • Make the payment under the conditions stipulated;
  • Accept these General Terms and Conditions

 

4.2. The order confirmation will be communicated by BS via email and will constitute BS’s signature and acceptance of the order.

 

4.3. Payment is made online or by bank transfer. No other form of payment is accepted.

 

BS shall not, under any circumstances, be held responsible for any issues the Participant may encounter during transactions with these various payment companies.

 

Article 5 – Pricing

 

5.1. The prices of Échappée’s services are indicated in the catalog in Euros, all taxes included (TTC), and are payable in Euros.

 

5.2. The indicated prices exclude all general costs and fees not specifically mentioned in the catalog.

 

5.3. BS reserves the right to modify its prices at any time but no later than at the time of contract conclusion.

 

The Participant acknowledges that, in the event of deregistration, they shall not be entitled to any reimbursement of fees or expenses from BS.

 

Article 6 – Events Accessible to All

 

6.1. The services are accessible to all Participants. Registration is exclusively online, under the conditions described on the website https://echappee.be/.https://

 

6.2. To register for events organized by Échappée, a Participant must:

  • Register online for the relevant event under the conditions indicated (dates, available spaces, registration deadline, etc.)
  • Pay the event fee as indicated at the time of registration;
  • Accept these General Terms and Conditions of Sale as well as any applicable internal regulations;
  • Possess a bicycle

 

Only the payment of the event fee validates the Participant’s registration for the event organized by BS.




Article 7 – No Right of Withdrawal

 

The Participant acknowledges having been informed that they cannot exercise a right of withdrawal when purchasing services on the Échappée website. According to Article VI.53, 12° of the Belgian Code of Economic Law, the consumer cannot exercise the right of withdrawal for leisure-related services if the contract specifies a specific date or period of execution.

 

Article 8 – Contract Termination and Cancellation

 

8.1. At the end of the season or the event organized by BS, all related services shall cease, except for access to the Virtual Platform, according to the terms and conditions provided in these General Terms and Conditions.

 

The Participant acknowledges and accepts that the contractual relationship between both parties terminates at the end of the competition season or event organized by BS.

 

8.2. In the event of any breach of the provisions of these General Terms and Conditions, BS may terminate the contract with the Participant by right and without further formalities, without reimbursement, and may restrict the Participant's access to its events, the Platform, and its content, and seek appropriate compensation for the damage suffered as a result of such breach.

 

8.3. Without prejudice to Article 8.2, BS may terminate the contract with the Participant by right and without further formalities and deny the Participant access to an event without justification if the Participant is reported or deemed to lack fair play, display aggression, or exhibit any other problematic behavior.



Article 9 – Image Rights

 

9.1. In the context of events organized by BS, the Participant authorizes BS to film or photograph them, alone or with others, for internal use or for advertising or informational purposes, specifically to promote BS’s activities.

 

Thus, BS is authorized to publish and use these images on its Site and any other media, including presentation brochures or on social media pages managed by BS.

 

9.2. This authorization is subject only to the Participant’s justified opposition to the dissemination of a particular image. The use and dissemination of the Participant’s image by BS shall not harm their reputation or privacy.

 

Article 10 – Intellectual Property

 

10.1. All intellectual elements made available to the Buyer (syllabi, slides, software programs, etc.) and all elements of the https://www.echappee.be/ website (text content, articles, dossiers, iconographic representations, illustrations, or original images, photos, tutorials, videos, diagrams, layouts, etc.) are protected by copyright laws and remain the exclusive property of the Seller. https://www.echappee.be/

 

No one is authorized to reproduce, exploit, redistribute, or use these elements in any way, even partially, regardless of the type (graphic, textual, audiovisual, sound, or software content).

 

10.2. Except with express derogation, the agreed price does not include any transfer of intellectual property rights in any capacity.

 

Article 11 – Liability and Claims

 

11.1. General provisions

11.1.1. BS is only bound by an obligation of means unless otherwise provided in these General Terms and Conditions of Sale. BS is only liable for its willful misconduct and gross negligence.

 

11.1.2. In the event of a failure to perform its obligations, BS’s liability shall not be engaged if the failure is attributable either to a third party to the contract or to a force majeure event as defined in Article 13 of these General Terms and Conditions.

 

11.1.3. Under no circumstances shall BS’s directors, officers, employees, agents, representatives, or proxies be held liable for any claim or damage, direct or indirect, arising from the use of the Site, paid or free services, or public information or the interpretation of this contract.



11.2. Sports Accidents

11.2.1. BS has third-party liability insurance covering "sports accidents" for all its activities. In the event of an accident, the Participant is required to follow the procedure established by BS. This procedure is available on the Virtual Platform and provides detailed information on how healthcare costs are covered or not.

 

11.2.2. The Participant acknowledges that BS is not liable for any direct or indirect damages caused by the services provided or resulting from a sports accident occurring during an activity organized by BS, such as loss of business or clientele, increased overhead costs, damage to reputation, etc.

 

11.3. IT System

11.3.1. In the online sales process, BS’s liability shall never be engaged due to failures by the internet service provider or the Site’s host, or for damage resulting from risks associated with using the Internet, such as data loss, hacking, computer viruses, service interruptions, or other involuntary issues beyond BS’s control.

 

11.3.2. BS reserves the right at any time to suspend access to the Site, its content, and services for maintenance or updates, without owing any compensation to the Participant.

 

Article 12 – Force Majeure

 

12.1. In the event of force majeure, the obligations of the parties are suspended until the force majeure ceases, or limited to what can be implemented considering the force majeure.

 

12.2. Force majeure is understood as any unforeseeable and unavoidable event beyond the parties' control that constitutes an insurmountable obstacle to fulfilling their obligations, including but not limited to restrictions related to a health crisis, the lack of sufficient electricity or natural gas, network failures, decisions made by the property owner or operator that make occupation of the premises and/or organization of the Event materially more burdensome and/or impossible, and any other cases or situations rendering occupation of the premises and/or organization of the Event considerably more burdensome and/or impossible.

 

12.3. In the event of force majeure, the Participant shall not be entitled to any refund of paid amounts or any compensation whatsoever from BS.

 

Article 13 – Change of Location, Date, or Complete or Partial Cancellation

 

13.1. Without prejudice to Article 12 above, if circumstances beyond the reasonable control of BS make it impossible to organize the announced events or part thereof at the planned location and time, BS may cancel, relocate, reschedule, or shorten the event.

 

The Participant hereby acknowledges that they shall not be entitled to any refund, compensation, or reimbursement of costs in such circumstances.

 

13.2. If BS decides not to hold certain events for any reason other than force majeure, only the reimbursement of payments already made shall be due to the Participant, with no right to claim damages or any further compensation (for potential losses or otherwise).

 

Article 14 – Protection of Personal Data

 

The protection of the Buyer's personal data is governed by a separate Privacy Policy available on the Site.

 

Article 15 – Severability

 

The potential nullity or unenforceability of any clause of these general terms and conditions shall not affect the validity of the remaining provisions. Failure by the Seller to invoke any provision of these terms shall not be construed as a waiver of the right to enforce it subsequently.

 

Article 16 – Governing Law and Jurisdiction

 

16.1. Belgian law shall exclusively apply.

 

16.2. Any dispute arising from or related to this agreement that cannot be resolved amicably shall fall under the exclusive jurisdiction of the courts of the judicial district of Brussels.
